Transaction Broker Notice
In Florida, it is presumed that all
licensees are operating as transaction
brokers unless a single agent or no
brokerage relationship is established,
in writing, with a customer.
Effective July 1, 2008, a real estate
licensee in a residential transaction
is no longer required to disclose the
duties of a transaction broker in writ-
ing to a customer. The presumption
of a transaction broker continues, but
the written disclosure requirement of
the real estate licensee has expired.
Members may still choose to pro-
vide the written transaction broker
disclosure, though it is no longer a
requirement to disclose the duties
of a transaction broker in writing.
